2. Scope of Application

These Terms and Conditions (T&C) apply to all contracts, orders and use of the website mysong-generator.com as well as all services and digital content offered via it. Deviating conditions of the customer do not apply.

3. Service Description

The operator offers the creation and delivery of digital, individually personalized content (especially songs). Delivery is exclusively digital (e.g. via email or download link). No physical products are delivered.

Content is provided manually. There is no entitlement to a specific delivery time, specific quality, specific style or specific result.

4. Contract Formation

A contract is concluded as soon as the payment process has been successfully completed.

By completing the order, the customer confirms that they have read, understood and accepted these Terms and Conditions.

5. Prices and Payment

All prices are displayed at the time of ordering.

Payment is made exclusively via the payment provider Stripe.

The operator has no access to customer payment data at any time.

6. No Right of Withdrawal / No Refunds

Any refund is excluded.

This applies in particular, but not exclusively, to:

Dislike of the result
Deviation from expectations
Subjective quality assessment
Technical problems on customer side
Delayed delivery
Partial or complete non-use of delivered content

By placing an order, the customer expressly and completely waives any right of withdrawal, cancellation or refund to the extent legally permissible.

7. Use at Own Risk

The use of the delivered content is exclusively at the customer's own risk. The operator assumes no guarantee or warranty for:

Content accuracy
Legal compliance
Suitability for a specific purpose
Completeness
Error-free operation
Availability
Compatibility
Quality or expectation fulfillment

8. Limitation of Liability

The liability of the operator is excluded to the maximum extent permitted by law.

In particular, the operator is not liable for:

Direct or indirect damages
Consequential damages
Financial losses
Reputational damage
Data loss
Service interruptions
Third-party claims

Liability exists exclusively in the case of intentional or grossly negligent behavior, to the extent required by mandatory law.

9. Copyright and Usage Rights

All delivered content remains the intellectual property of the operator, unless mandatory law provides otherwise.

The customer is granted a simple, non-transferable, non-exclusive right of use exclusively for private use.

Commercial use, resale, publication, reproduction or transfer to third parties is prohibited unless expressly approved in writing.

10. Customer Content

The customer assures that all content transmitted by them (texts, names, information) is lawful and does not violate any third-party rights.

The customer fully indemnifies the operator against all third-party claims.

11. Availability

The operator assumes no guarantee for the permanent availability of the website or services. Maintenance, technical disruptions or failures can occur at any time.

12. Applicable Law and Jurisdiction

Exclusively Swiss law applies, excluding the conflict of laws.

Place of jurisdiction is Zurich, Switzerland.

13. Severability Clause

If any provision of these Terms and Conditions is invalid or unenforceable, the validity of the remaining provisions remains unaffected.
